The Purchase Agreement

This agreement is between, James & Elizabeth Himebaugh (hereinafter referred to as Seller) and (hereinafter referred to as Buyer).
Both Seller and Buyer, voluntary enter into and agree to all terms delineated in this contract as witnessed by their signature below.
The purchase price is for the below described German Shepherd Dog and is NONREFUNDABLE. DESCRIPTION OF

SELLER'S REPRESENTATION
1. As of the date on this agreement, the dog is in good health and free of communicable diseases.
2. The Buyer has 1 week to have the dog examined by a veterinarian and to personally inspect the dog.
Any claims must be made within this time period and will be verified by Seller's own veterinarian in that 1st week.
after that the buyer waives all claims. If buyer still wants said dog the agreement and all guarantees and obligations
made by the Seller shall be terminated .
3. Should the dog be diagnosed at any time in its first year of life with any genetically derived medical disorder, in which is considered by 2 unassociated veterinarians “ Provided by Buyer” , to be extreme enough to warrant euthanasia, Seller will upon provision of veterinary reports, provide Buyer with a replacement Puppy/Dog of similar breeding and sex. only upon next Availability litter and only one replacement puppy per sale with no guarantees and obligations on replacement puppy.
4. Buyer is completely satisfied with and waives any and all claims regarding the dog's conformation, and outward appearance.
5. AKC registration papers will be released to Buyer after all financial arrangements are met, but not prior the first week.
No refunds of money.
CONSIDERATION
1. This above described Dog is being sold for the sum of $_______________
STIPULATION
1. If dog is diagnosed with Crippling Hip Dysphasia, By buyer's veterinarian and the Orthopedic Foundation for Animals (OFA),
up to the age of 1 year, Buyer can either agree to keep the dog providing dog is spayed or neutered. Buyers must provide to
seller a veterinarian stating said dog is spayed or neutered. Seller agrees to replace said dog with anotherpuppy/dog of similar
breeding and sex. Upon next Availability litter - without requiring you to give back your beloved companion.
The Buyer accepts full responsibility of this dog and its actions, whether sold as a trained or untrained animal, and fully indemnifies the seller from any cause or actions related to this dog once it leaves the Seller's possession.
Buyer must note that the health of a dog’s hips and elbows are not determined 100% by genetics.
It is thought that environment plays a 70-75% role in a dog’s development of good joints,
while genetics are only responsible for the other 25-30%. For this reason, Buyer must understand the importance
of following the guidelines set in the ‘Maintenance and Health Care’
portion of this contract. **Hip status must be confirmed by providing Breeder with copy of OFA or SV
results which require Micro Chip Number with certificate, and Reg. Name of Dog**.
(Do not x-ray 5wks before or after heat cycle, this can cause Subluxation (loose joints) and Buyer will be asked to repeat the x-rays.)
we recommend x-raying 10 weeks after the start of the Heat Cycle.
2. Any other arrangement may only be made with Seller's written consent.
3. If Buyer sells or transfer ownership of the above purchased dog, all guarantees and obligations made by the Seller shall be terminated at the time of the sale or transfer.
4. If we are no longer breeding German Shepherds, the replacement stipulation will be null and void.
5. Seller will only give one replacement puppy from original agreement. Then the Seller/Breeder shall be under no further obligation, Buyer has released the Seller/Breeder from any and all further claims.

LIMITATION OF CONTRACT
1. This contract applies to the original dog only and is nontransferable to second party.
2. Should Buyer choose to break any of the covenants of this agreement, the remainder of the agreement will be considered null and void.

Maintenance and Health Care
1. Buyer agrees to maintain this dog in good health, provide routine preventative health care, including, but not limited to, inoculation, internal and external parasites, and - where indicated - heartworm preventative medication.
2. Buyer further agrees to provide proper exercise as indicated in order to maintain this dog in proper weight and physical shape.
3. The buyer agrees to feed Eukanuba or Iams with natural ingredients and vitamins and minerals and no artificial preservatives, wheat gluten and zero fillers and your giving your new German Shepherd puppy a healthy start that will last a life time. Failure to provide either Eukanuba or Iams products for your new German Shepherd will void this contract and agreements/guarantees, because of the variety and quality of dog foods available, and all canine illness are not covered by vaccinations, we recommend that all of our dogs/puppies be kept on Eukanuba German Shepherd Formula, Iams products is a great 2nd choice to the Eukanuba line, if Eukanuba products are to expensive for owner. A breed this dependable deserves dependable digestion. German Shepherds are prone to having digestive issues. Eukanuba product are tailored to their needs.

TEMPERAMENT

1. Seller shall not be held responsible for acts of Puppy or adult Dog once Buyer has possession of the animal.
2. Seller recommends that Buyer attend obedience class with Puppy/German Shepherd and provide proper socialization
opportunities for the puppy.
